The Comprehensive Environmental Response, Compensation and Liability Act ("CERCLA" or "Superfund") states that a purchase of real estate can only be shielded from future liabilities associated with the real estate by performing a "due-diligence" environmental site assessment. Bowser-Morner has assisted industry, attorneys, lending institutions, real estate firms and various governmental agencies in the purchase, sale or transfer of property by conducting a Phase I environmental site assessment. Typical problems addressed during these assessments are:

Building Surveys
Spills (hydrocarbons, solvents, PCB's, etc.)
Surface & Groundwater Contamination
Buried Tanks (in situ evaluation and during removal)
Records Search

The Phase I assessment consists of a preliminary inspection of the project site to delineate potential areas of environmental concern. This is accomplished by performing a physical site investigation of the property, as well as an environmental records search to obtain information of public record. If the presence of contaminants are suspected on the site, then a Phase II assessment is recommended.

Phase II assessments consist of designing and implementing a sampling and analysis program for any suspect areas found during Phase I.

Phase III involves implementing a remediation process to clean-up the site.

Bowser-Morner has the resources to assist a client from Phase I through Phase III. These capabilities include: sampling and monitoring of buildings and grounds; subsurface exploration including soil sampling and monitoring well installation; engineering and hydrogeologic consulting services; and chemical and physical analysis of soil, water and building materials.

Our projects are completed with primary emphasis given to environmental safety and compliance with regulatory requirements while being highly responsive to the client's needs.

Equally important is that test methodology is performed in compliance with the USEPA and ASTM Standards.
